Refund & Cancellation Policy

Davel Creative Agency

Effective Date: August 10, 2026 · Last Updated: August 10, 2026

Summary

We work on fixed-fee engagements and our fees pay for work performed.

  • Your signed agreement controls. Where it differs from this page, it wins.
  • Fees for work already performed are earned and not refundable.
  • You can cancel on the notice period in your agreement — usually 30 days' written notice.
  • Advertising spend is never refundable by us, because it goes to the platform, not to us.

1. What you are paying for

Our fees pay for services performed — strategy, creative production, media management, development, and account management — not for a result, unless a signed guarantee addendum says otherwise.

2. Cancelling

2.1 Notice. Give the written notice your agreement requires — usually 30 days. Your engagement continues, and remains billable, through the notice period.

2.2 How. Whichever is easiest:

  • Email support@davelcreative.com, subject "Cancellation Request"
  • Reply to any invoice or billing email with "Cancel"
  • Phone +1 (818) 934-0618

We will not require you to call to cancel something you started online, and we will not put you through a retention script or make you complete a survey first.

2.3 Confirmation. We will confirm your cancellation in writing, stating your final service date and any final amount due.

2.4 Effect. Cancellation takes effect at the end of the current billing period. We do not prorate partial periods. You keep the deliverables you have paid for, on the licence terms in your agreement.

2.5 Term commitments and early termination. Many of our agreements run for a fixed term — commonly twelve months. Where your agreement provides for an early termination fee, it applies, and the amount is stated in the agreement you signed. An early termination fee is not payment for services; it compensates us for ending the term early.

2.6 Automatic renewal. Where your agreement renews automatically, the renewal term, the amount, and the notice needed to cancel are set out in it, and you agree to them separately before the first charge. Where the law requires us to send a renewal reminder, we will.

3. When we do refund

We will refund you, without argument, where:

  • We billed you in error — a duplicate charge, a charge after cancellation, or a wrong amount
  • We did not deliver something discrete you paid for and cannot or will not deliver it
  • Your signed guarantee addendum entitles you to a refund — see Performance Guarantee Terms
  • We end the engagement for our own convenience, in which case we refund fees prepaid for work not yet performed
  • The law requires it

We do not refund because of dissatisfaction with our creative judgment, style, or approach, where the work was delivered as scoped. Creative work is subjective and we agree the scope with you in advance.

Approved refunds are issued to the original payment method where possible.

4. Advertising spend

We never refund advertising spend. It is paid to the advertising platform, not to us, and once impressions are delivered only the platform can decide whether to credit it.

If a platform makes a billing or delivery error, we can help you raise it with them, though we cannot control the outcome. Unspent balances held by a platform in an account you own remain yours.

5. Free trials

Where we offer one:

  • The length of the trial, and the price it converts to, are disclosed before you start.
  • Unless you cancel before it ends, it converts to a paid engagement.
  • Cancel at any time during the trial and you are charged nothing.
  • One trial per person or organisation. We may decline a trial where that limit is being circumvented.

6. Goods and digital products

Where you buy a product, download, course, or ticket through our website:

  • Physical goods — returnable unused and resalable within 30 days of delivery. Contact us first. We pay return shipping if the item was defective, damaged, or not what you ordered.
  • Digital products and downloadsnot refundable once accessed or downloaded. If a file is defective or won't open, we will replace it or refund it.
  • Courses, memberships, and tickets — refund terms are stated on the sales page before purchase and control over this section.
  • Anything defective or not as describedfull refund or replacement, your choice.

If we cancel your order for a pricing error or unavailability, you receive a full refund and we will tell you why.

7. Non-payment

Invoices are due on the terms stated in your agreement or invoice. Overdue amounts may accrue interest at the lesser of 1.5% per month or the maximum permitted by law, and we may suspend services on notice and recover reasonable collection costs. Suspension for non-payment does not entitle you to a refund and does not extend a guarantee period.

8. Chargebacks

Contact us before disputing a charge with your bank — most billing questions resolve quickly. Raising a chargeback without contacting us first is a breach of your agreement, and we may suspend services and recover our costs of responding.

None of this limits your rights under applicable law or your card agreement. If a charge is genuinely unauthorised, contact your bank — that is what the dispute process is for.

9. Your statutory rights

Nothing here waives any right you have under the Consumers Legal Remedies Act (Cal. Civ. Code § 1750 et seq.), the Song-Beverly Consumer Warranty Act, or any other consumer protection law.
